Agency Handy Terms and Conditions

These Terms and Conditions (“Terms”) govern the use of the services provided by Agency Handy (“we”, “us”, “our”) and apply to all users of our platform. By accessing or using Agency Handy, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our services.

• Superadmin/ Admin: Users with administrative control and access to various configuration and management tools.
• Services: Refers to all the tools and functionalities provided through the Agency Handy platform.

• Agreement: The legal contract between you and Agency Handy, encompassing these Terms.

2. Acceptance of Terms

By registering or using Agency Handy, you acknowledge that you have read, understood, and agreed to these Terms. We reserve the right to modify or update these Terms at any time. All changes will be posted on our platform, and your continued use signifies acceptance of any revisions.

3. Services Provided

Agency Handy offers a suite of tools to help agencies manage projects, communicate with clients, track tasks, and facilitate other operational needs. This includes but is not limited to:

• Billing and invoicing support.

4. User Responsibilities

Users agree to:

• Provide accurate and complete information when registering.
• Maintain the confidentiality of account information, including usernames and passwords.
• Use the Platform only for lawful purposes, in compliance with all applicable laws and regulations.
• Not engage in activities that may harm, disrupt, or interfere with the Platform’s normal operation.
• Be responsible for the security of their data and personal information.

5. Prohibited Activities

You agree that you will not engage in any of the following prohibited activities when using Agency Handy services:

1. Violation of Laws
   
   
   • Engaging in any activities that violate local, state, or national laws or regulations.
   • Promoting or facilitating illegal activity through the platform, including the distribution of illegal content or access to pirated software.
2. Misuse of Platform
   
   
   • Using the Platform in any way that could disable, overburden, or impair the Platform’s functionality or interfere with others’ use of the Platform.
   • Engaging in activities that could interfere with, disrupt, or negatively affect the operation of the Platform or the experience of other users.
3. Fraudulent or Harmful Activities
   
   
   • Engaging in fraudulent activity, including impersonating others, providing false information, or misrepresenting yourself or your company.
   • Distributing malware, spyware, viruses, or any harmful code through the Platform.
4. Infringing Intellectual Property
   
   
   • Uploading, transmitting, or distributing content that infringes upon the intellectual property rights of others, including copyrighted material without proper authorization.
5. Harassment or Abusive Behavior
   
   
   • Harassing, threatening, or otherwise mistreating other users, clients, or employees of Agency Handy.
   • Posting or transmitting any offensive, hateful, or discriminatory material or comments, including any content that promotes violence, racism, or intolerance.
6. Spam or Unsolicited Communication
   
   
   • Sending spam, unsolicited marketing materials, or promotional content to users or clients through the platform.
   • Using the Platform for unauthorized mass communications, including any form of “junk mail,” “spam,” or “chain letters.”
7. Unauthorized Access
   
   
   • Attempting to access or gain unauthorized access to another user’s account, data, or systems through hacking, password mining, or any other illegal means.
   • Circumventing any security or access controls in place to prevent unauthorized access to the Platform.
8. Exploiting User Data
   
   
   • Using, selling, or sharing any personal data or user information without proper consent, except as required by law or outlined in our Privacy Policy.
   • Collecting or harvesting personal data without the user’s consent.
9. Excessive Use of Resources
   
   
   • Using automated methods (such as bots, scripts, or crawlers) to interact with the Platform in a manner that could damage, disrupt, or place excessive load on the Platform’s infrastructure.
10. Abuse of Support System
    
    
    • Using the helpdesk or support system to submit false, malicious, or misleading inquiries.
11. Engaging in Activities Related to Unlawful Content
    
    
    • Uploading, sharing, or otherwise engaging with content that is pornographic, defamatory, offensive, or otherwise unlawful, as determined by applicable laws.
12. Encouraging or Enabling Any of the Above
    
    
    • Encouraging or enabling any individual or entity to engage in any of the prohibited activities listed above.

Consequences of Violating Prohibited Activities

If you engage in any of the above prohibited activities, we may, at our sole discretion, suspend or terminate your account and access to the services. In addition, we may take legal action to recover damages and enforce compliance.

6. Privacy and Data Protection

This policy is compliant with the General Data Protection Regulation (GDPR), and by using our services, you consent to our collection and processing of your personal data as outlined.

• Subscription Changes: You may change or cancel your subscription at any time through your account settings. Upon cancellation, you will continue to have access to the services until the end of your billing cycle.

9. Intellectual Property

• Agency Handy’s Content: All content, including software, images, logos, and design elements, is the property of Agency Handy and is protected by copyright laws.
• User-Generated Content: You retain ownership of the content you upload or create using Agency Handy services. However, by uploading content to the Platform, you grant us a license to use, store, and process it as necessary to provide our services.

10. Limitations of Liability

Agency Handy will not be held liable for:

• Any indirect, incidental, special, or consequential damages arising from the use or inability to use the services.
• Loss of data, revenue, or profits, whether incurred directly or indirectly.
• Any interruption or failure of the services due to third-party providers or technological issues outside of our control.

11. Dispute Resolution

• Governing Law: These Terms are governed by the laws of the country in which Agency Handy operates.
• Arbitration: Any disputes arising from the use of Agency Handy shall be resolved through arbitration, with a neutral third-party mediator.

12. Termination

We reserve the right to suspend or terminate your account and access to the services if you:

• Fail to pay subscription fees.
• Engage in any activity that disrupts the functioning of the Platform.

Upon termination, you will lose access to your account and all associated data. If you have a subscription, you may be entitled to a refund based on the specific terms of your plan.

Agency Handy is not responsible for delays or failures to perform due to circumstances beyond our reasonable control, including but not limited to natural disasters, internet failures, or government actions.
